What is a debtors list?
-
A debtors list is a document showing the names of individuals and legal entities that have defaulted on payments to certain banks.
-
The list of defaulters is used by banks and other credit institutions as part of their analysis of granting credit or other types of financing to a client.
-
In other words, in this list we can find out if a person or company was granted a financial product, for example, a loan, and the funds have not been returned to the bank within the agreed time period, thus generating a debt.
-
Debtors’ files are also used by companies to guarantee their trade agreements with customers or suppliers.

HOW DO I KNOW IF I AM ON A LIST OF DEBTORS?
If a bank includes you in a debtors list, you will be notified via certified letter. People are often unaware of their inclusion in one of these lists due to the certificate going astray, or not arriving for various reasons.
Any person therefore has the right to know if their name appears in a debtors list, provided they prove their identity.
HOW CAN I BE REMOVED FROM A DEBTOR LIST?
Usually the affected party has to request their removal from the debtors list once they are up to date with their payments and debts. The affected party must provide the debtors register documentation that certifies the effective payment of their debt with the institution. The person responsible for the debtors list has 10 days to respond; if there is no response, the affected party can submit a claim before the Spanish Agency for Data Protection.
